Murderer’s family asks for furlough for funeral

The family of convicted murderer Jose Orozco Diaz Jr. has formally requested that he be furloughed from Monterey County Jail so he can attend the funeral of his father, who was shot to death early Thursday. Funeral services are set Tuesday for Jose Lopez Diaz, 44, who was shot in the back of the head in the living room of his Cross Avenue home in Salinas. The killing came one week after his son, Diaz Jr., 26, was convicted of first-degree murder in the shooting deaths of his estranged wife and her lover. A jury found Diaz Jr. guilty of murdering Jennifer Miller, 22, and Jose Serrano, 26, after he discovered them together in Serrano’s bed. Serrano lived in a studio apartment behind his family’s home, two doors down from the Diaz family home on Cross Avenue. The Diaz family, as well as Milelr’s mother, have said they believe the elder Diaz was killed in retaliation for his son’s crimes. Police have made no arrests in the case and said they have no evidence the two cases are related. On Friday, Sheriff’s Sgt. Joe Schumaker confirmed that the Diaz family submitted paperwork asking that Jose Diaz Jr. be allowed to attend his father’s funeral, which will be held Tuesday at 1 p.m. at Healey Mortuary in Salinas. Burial will follow in the Garden of Memories Cemetery. Schumaker said a decision on the family’s request would be made by jail commander Lt. Steve Deering, probably on Monday. If Diaz Jr. were allowed furlough, Schumaker said, it would be only long enough to attend the funeral and he would be accompanied by at least two deputies at all times. Diaz Jr., 26, is in Monterey County Jail awaiting a May 18 sentencing date. Because the jury found him guilty of the special circumstance of multiple murders and because Deputy District Attorney Elaine McCleaf was not seeking the death penalty in the case, he will be sentenced to life in prison without possibility of parole.

Jose Lopez Diaz died Thursday as a result of a shooting. He was 44. Born May 17, 1955, in Moreleon, Guanajuato, Mexico, he lived in Salinas for 24 years. He is survived by his wife, Beatrice; a daughter, Yisel Diaz of Salinas; two sons, Jose O. Diaz and Albert Diaz, both of Salinas; father, Frederico Diaz of Mecca; mother, Maria Diaz of Salinas; maternal grandmother, Elodia Lopez of Salinas; one grandddaughter; and numerous nieces and nephews. Visitation will be from 1 p.m. to 5 p.m. Sunday and from 1 p.m. to 9 p.m. Monday at Healey Mortuary in Salinas. Funeral services will be held at 1 p.m. Tuesday at he the mortuary chapel. Burial will follow in the Garden of Memories Cemetery.
